1. General provisions
1.1. These online store rules (hereinafter – the Rules) are a legally binding document for the Buyer and the Seller (hereinafter – the Seller), establishing the rights and obligations of the Parties.
1.2. The Seller reserves the right to amend, revise or supplement these Rules at any time. The Buyer is informed of changes to the Rules on the online store website.
2. Conclusion of the purchase and sale agreement
2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded when the Buyer forms and submits a product order in the online store, having first familiarised themselves with these rules and ticked the statement “I have read and agree to the www.bimori.lt Rules”.
3. Seller's rights
3.1. In important circumstances, the Seller may temporarily or permanently suspend the operation of the online store without prior notice to the Buyer.
3.2. If the Buyer attempts to harm the operation, stability or security of the online store or breaches their obligations, the Seller has the right to restrict or suspend the Buyer's access to the online store without warning.
4. Seller's obligations
4.1. The Seller undertakes to enable use of the online store services, the terms of operation of which are set out in these Rules.
4.2. The Seller undertakes to deliver goods purchased by the Buyer using the delivery method chosen by the Buyer, in accordance with these purchase and sale Rules.
4.3. If due to unforeseen circumstances the Seller cannot deliver goods ordered in the online store, the Seller has the right to terminate the purchase and sale agreement after informing the Buyer. The Seller may offer an analogous product. If the Buyer refuses, the Seller undertakes to refund payment within 3 (three) business days.
4.4. When the Buyer exercises the right provided in Section 5.2 of the Rules, the Seller undertakes to refund payment to the Buyer within 5 (five) business days from the day the returned goods are received.
4.5. The Seller may withhold refund of the amount paid by the Buyer until the goods are returned to the Seller or until the Buyer provides proof that the goods have been sent to the Seller, whichever occurs first.
5. Buyer's rights
5.1. The Buyer has the right to purchase goods in the online store in accordance with these Rules.
5.2. The Buyer has the right to withdraw from the purchase and sale agreement for goods concluded in the online store by notifying the Seller in writing no later than 14 (fourteen) calendar days from the day of delivery of the goods.
5.3. The Buyer may exercise the right referred to in Section 5.2 only if the goods have not been damaged or substantially altered in appearance and have not been used, except for goods manufactured according to the Buyer's personal needs or specifications.
6. Buyer's obligations
6.1. The Buyer must pay for purchased goods and accept them in the manner provided in these Rules.
6.2. If the Buyer refuses to accept goods during delivery without good reason, the Buyer must cover return shipping costs at the Seller's request.
6.3. When goods are delivered to the Buyer, the Buyer must together with the Seller or the person delivering the shipment inspect the condition of the shipment and the goods.
6.4. By using the online store, the Buyer confirms agreement with these purchase and sale rules and must comply with them.
7. Product prices
7.1. Product prices in the online store are shown in euros. Prices include VAT. Upon order confirmation, a delivery fee is added to the total product amount if applicable.
8. Ordering and payment
8.1. When visiting the online store, the Buyer selects desired products and adds them to the shopping cart. After forming the cart, the Buyer enters personal data required to fulfil the order: name, surname, delivery address, phone number and any additional information relevant to delivery.
8.2. The Buyer confirms that they have read these rules and confirms the order.
8.3. Payment is available via Swed, SEB, Luminor, Citadele, Šiaulių Bankas online banking services and Visa / MasterCard payment cards. Payments are made in euros.
8.4. If the Buyer fails to pay within 24 hours by advance bank transfer or online banking, the purchase and sale agreement is terminated and the Seller is not obliged to deliver the goods to the Buyer.
9. Delivery of goods
9.1. When ordering goods, the Buyer must provide an accurate delivery address.
9.2. The Buyer must accept the goods in person. If the Buyer cannot accept the goods in person but they are delivered to the address specified by the Buyer, the Buyer may not claim that the goods were delivered to the wrong person.
9.3. The Seller delivers goods to the Buyer in accordance with the terms stated in product descriptions.
9.4. Properties of all goods sold are indicated in each product description. The Seller is not liable for colour, shape or other parameters of goods displayed in the online store differing from actual size, shape and colour due to the Buyer's monitor characteristics.
9.5. When the Buyer withdraws from the purchase and sale agreement, all amounts paid by the Buyer are refunded, including delivery costs paid by the Buyer.
10. Return of goods
10.1. Goods of satisfactory quality may be returned within 14 days of receipt. Defects in non-conforming goods sold are remedied and non-conforming goods are replaced or returned in accordance with the Civil Code of the Republic of Lithuania.
10.2. When returning goods, the following conditions must be met:
10.2.1. Returned goods must be in their original tidy packaging;
10.2.2. Goods must be undamaged by the Buyer;
10.2.3. Goods must be unused and retain their commercial appearance;
10.2.4. Returned goods must be of the same complete set;
10.2.5. The Seller has the right to refuse to accept goods returned by the Buyer;
10.2.6. Returns must be made within 14 days of receipt of the goods.
10.3. Return and exchange of goods of satisfactory quality is carried out in accordance with Article 6.22810(1) of the Civil Code.
10.4. Money paid for goods accepted by the Buyer but later refused is refunded to the Buyer's account no later than 7 days from the day the goods are returned to the Seller.
10.5. Pursuant to Section II, Chapter 1 of the Retail Trade Rules, buyers who have purchased goods may not return works of art (Combined Nomenclature codes 9701–9706).
11. Final provisions
11.1. These Rules are drawn up in accordance with the laws of the Republic of Lithuania.
11.2. These Rules and relations between the parties in respect of these Rules are governed by and interpreted in accordance with the laws of the Republic of Lithuania.
11.3. All disputes arising from the performance of these Rules shall be resolved through negotiation. If no agreement is reached, disputes shall be resolved in accordance with the laws of the Republic of Lithuania.
11.4. The parties are released from obligations under these Rules if they cannot be performed due to unforeseen circumstances beyond the parties' control (force majeure).
12. Provision of personal data
The information collected about Users (buyers) depends on the services provided by the Seller and what information the Buyer provides on the bimori.lt online store when starting to use the services or registering an account.
The Buyer's personal data is obtained in the following ways:
• Provided by the Buyer (by completing and submitting a request form on the website)
• Generated automatically
• Obtained from third parties
The Buyer may perform purchase actions when registered. The Buyer is responsible for providing their Personal Data accurately and correctly.
The Seller collects and processes the Buyer's personal data on lawful grounds defined in personal data protection legislation: when required by applicable law, to conclude and/or perform a contract, with your consent, and for the Seller's legitimate interests.
13. Use and storage of personal data
The User (buyer) grants the right to collect, manage, process and store the Buyer's Personal Data to the extent and for the purposes specified in the Privacy Policy and other bimori.lt documents.
The Seller stores Users' (buyers') personal data for as long as necessary to achieve the specified purpose. Once the purpose is achieved, Buyers' personal data is deleted, except where applicable law requires the Seller to retain personal data for a period specified in such law.
The Seller uses internal organisational and technical measures to ensure that Personal Data provided by the Buyer is protected against unlawful actions: unlawful alteration, disclosure or destruction of Personal Data, identity theft, fraud, and compliance of the personal data protection level with the requirements of the laws of the Republic of Lithuania.
The Buyer undertakes and must protect their bimori.lt login password, username and other credentials. The Buyer undertakes and must not disclose Personal Data about themselves or third parties to any other third parties.
14. Rights of data subjects
The User (buyer) whose personal data is processed by the Seller has the following rights:
• To be informed about the processing of their data
• To access their personal data and how it is processed
• To request correction or deletion of their personal data
• To object to the processing of their personal data
All listed data subject rights will be implemented after establishing and verifying the identity of the person making the request.
Any request or instruction related to the processing of Personal Data must be submitted to the Seller in writing:
• By delivering the request directly to the Seller: Kretingos g. 96, Klaipėda
• By email: info@bimori.lt
Upon receiving such a request or instruction from the Buyer, the Seller shall respond to the Buyer and perform the actions specified in the request or refuse to do so no later than within 30 calendar days.
15. Use of cookies
When visiting bimori.lt, cookies are used. These are small pieces of information stored in the Buyer's web browser that help recognise the Buyer as a previous visitor, save browsing history and tailor content accordingly. Cookies also help ensure smooth operation of the website and online store, allow monitoring of visit duration and frequency, and collect statistical information about the number of visitors. By analysing this data we can improve and make the site more convenient for the Buyer.
Cookies used by the Seller do not independently identify a specific person. Data collected via cookies relates more to use of a specific computer than to a specific internet user, but the Buyer may refuse cookies by selecting certain settings in their browser. However, please note that in such case the Buyer may not be able to use all features provided by the website.
