1. General provisions
1.1. These purchase and sale rules (hereinafter – the Rules) establish the mutual rights, obligations and liability of a person purchasing goods in the online store www.bimori.lt (hereinafter – the Buyer) and the seller when the Buyer purchases goods in the online store. By purchasing goods in the online store, the Buyer agrees to these Rules.
2. Conclusion of the purchase and sale agreement
2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded when the Buyer, having formed a shopping cart in the online store, provided information about themselves: name, surname, delivery address, email, phone number, selected a payment method and familiarised themselves with these Rules, clicks the “Order” button, and remains valid until full performance of obligations under this agreement. If the Buyer does not agree with all or part of the Rules, they must not submit an order.
3. Seller's rights
3.1. The Seller has the right to temporarily or permanently suspend the operation of the online store, after notifying Buyers, and undertakes to ship ordered goods for which the Buyer has already paid.
3.2. The Seller has the right to unilaterally amend these Rules by publishing the amended Rules on the online store website. Amendments take effect from the moment of publication for all transactions concluded after publication.
3.3. The Seller has other rights provided for in these Rules and the laws of the Republic of Lithuania.
4. Seller's obligations
4.1. The Seller undertakes to make efforts to enable the Buyer to properly use the services provided by the online store. The Seller provides no guarantee that the online store will operate without interruption or that data transmission will be error-free. The Seller is not liable for any Buyer losses related to online store operation disruptions and/or data transmission errors.
4.2. The Seller undertakes to ship ordered goods to the Buyer within 7–10 business days from payment for the goods.
4.3. The Seller undertakes to replace goods purchased by the consumer free of charge if they are the wrong size with analogous goods of other dimensions, shape, colour, model or complexity. If the Seller does not have suitable replacement products, the Buyer has the right to return the product to the Seller and recover the price paid. In this case, the Seller undertakes to refund the Buyer within 10 business days and is released from liability for non-delivery of goods.
4.4. The Seller undertakes to comply with other requirements set out in these Rules.
5. Buyer's rights
5.1. The Buyer has the right to purchase goods in the online store in accordance with these Rules and the laws of the Republic of Lithuania.
5.2. The Buyer (consumer) has the right to withdraw from the purchase and sale agreement for goods concluded in the online store with the Seller by notifying the Seller in writing within 14 business days from the day of delivery of the goods. The Buyer may withdraw from the purchase and sale agreement with the Seller only if the goods are of satisfactory quality, undamaged and their appearance has not substantially changed.
5.3. The Buyer has other rights provided for in these Rules and the laws of the Republic of Lithuania.
6. Buyer's obligations
6.1. The Buyer must pay for the goods and their delivery, as well as other payments (if specified when concluding the agreement), and accept the ordered goods.
6.2. Goods begin to be produced and the Seller starts performing the purchase and sale agreement only when the Seller receives notification from the Buyer's bank about payment for the selected goods.
6.3. The Buyer must comply with other requirements set out in these Rules and the laws of the Republic of Lithuania.
7. General liability
7.1. The Buyer is responsible for the accuracy of the data provided. The Buyer assumes responsibility for consequences arising from incorrect or inaccurate data.
7.2. For breach of the purchase and sale agreement concluded using the online store, the parties are liable in accordance with the laws of the Republic of Lithuania.
7.3. The Seller is not liable for goods displayed in the online store differing in colour, shape or other parameters from actual goods in size, shape and colour due to the characteristics of the Buyer's display.
7.4. The Seller is not liable for changes in product quality if the Buyer used the garment without following the washing and other care instructions indicated on the label.
7.5. By this agreement, the Seller warns that when worn and washed, the fabric colour, structure or other properties of the garment may change.
8. Processing of personal data
8.1. By clicking the “Order” button, the Buyer confirms that they and their representatives (the Buyer has the consent of their representatives) agree to provide their personal data to the Seller and do not object to the Seller processing the personal data provided by the Buyer and/or their representatives for the purposes of identifying the Buyer and/or their representatives, concluding and performing agreements (online trade), as well as for direct marketing purposes. The Seller states that it will not process the personal codes of the Buyer (if a natural person) and their representatives for direct marketing purposes.
8.2. By clicking the “Order” button, the Buyer confirms that they (if the Buyer is a natural person) and their representatives are informed of their right to access their personal data processed by the Seller and how they are processed, to request correction or deletion of their personal data or suspension of processing when data is processed in violation of legal provisions, and to object to processing of their personal data.
8.3. By clicking the “Order” button, the Buyer confirms that they and their representatives know they have the right to refuse to provide personal data, but understand that personal data is necessary and required to unambiguously identify the Buyer and/or their representatives for the purposes of concluding and performing agreements (online trade), and that without providing personal data and/or without consent to processing for the above purposes, they will not be able to conclude and/or perform the agreement.
9. Sending of information
9.1. The Seller sends all informational notices and notices for direct marketing purposes to the email address provided by the Buyer in the registration form.
9.2. The Buyer sends all notices and questions using the contact details provided in the Seller's online store.
10. Final provisions
10.1. The Buyer and the Seller agree that all information published on the Seller's online store website (including but not limited to these Rules, information about the Seller, offered goods and services and their properties, the procedure for exercising the Buyer's right to withdraw from the purchase and sale agreement, product care services and warranties provided by the Seller (if any)) is deemed to have been provided to the Buyer in writing.
10.2. All disputes arising from or related to the purchase and sale agreement between the Buyer and the Seller shall be resolved through negotiation. If no agreement is reached, disputes shall be resolved in accordance with the laws of the Republic of Lithuania.
